Terms of Use

These Terms of Use govern access to and use of the EverLMS training platform and the Environmental Sustainability and Climate Change Compliance Training program. By creating an account or accessing the content, you agree to be bound by these terms. If you do not agree, do not access the service. The content, software, and services are provided on an as is basis and EverLMS disclaims warranties to the maximum extent permitted by law.

License and access. EverLMS grants a non-exclusive, non-transferable license to use the platform for your organization, subject to payment, user limits, and compliance with these terms. You may permit your employees and contractors to access the content solely for internal business purposes and not for resale or redistribution. You may not reverse engineer, decompile, or attempt to extract source code, and you may not remove or obscure any proprietary notices.

Intellectual property. All content provided within the program, including text, images, assessments, and templates, remains the property of EverLMS or its content providers. You are granted a license to view and use the content for internal training purposes; you may not copy, reproduce, or create derivative works beyond the allowed license without express written consent.

Data and privacy. The platform collects information in accordance with the Privacy Policy. You are responsible for safeguarding login credentials and for all activity under your account. We may suspend access for activity that violates these terms or for security reasons. We may update the terms from time to time; continued use constitutes acceptance of changes.

Limitations of liability. In no event shall EverLMS be liable for indirect, incidental, special, or consequential damages arising from use of the platform. Our liability, if any, shall be limited to the amount paid by your organization for access in the twelve months prior to the event giving rise to the claim. Governing law and venue. These terms are governed by the laws of the jurisdiction in which EverLMS is incorporated, without regard to conflict of laws principles. Any disputes shall be resolved in the appropriate courts, and the prevailing party may seek recovery of legal fees where permitted by law.
